Removal Defense: Immigration Court representation to fight deportation and seek relief from removal through, adjustment of status, cancellation of removal for permanent residents and non-permanent residents, asylum, withholding of removal, Convention Against Torture relief, NACARA, VAWA special rule cancellation, relief for old convictions under 212(c), as well as waivers for inadmissibility.
Detained Representation: This can be perhaps the most stressful situation of all, where a loved one is detained by Immigration and Customs Enforcement (ICE) at either Bristol House of Corrections, Suffolk County Jail, Plymouth County Jail, Strafford County Jail in Dover, New Hampshire or any other ICE facility in the United States. Here, time is of the essence. We need to immediately assess bond eligibility either through a request through ICE, or a redetermination before the judge. Thereafter, all relevant documentation must be sought and evaluated and filed. We have had great success with obtaining release from custody, but Richard will always give you an honest assessment of each individual case and the chances of favorable outcome, as each case and each client’s story brings with it its own unique history and set of facts and a professional and thoughtful assessment of your case is the hallmark of our representation.
Adjustment of Status: We represent individuals in adjusting their status, both before the court and at USCIS. We represent people seeking adjustment through a family based petition, a VAWA self-petition or an employment based petition (Labor certification PERM). We also represent individuals who present unique issues regarding their adjustment of status including waivers of inadmissibility, and those who may adjust under 245(i) and 245(k) of the Immigration and Nationality Act.
Asylum: We represent individuals who wish to pursue Asylum both affirmatively (at the asylum office) and defensively in court.
Employment Based Immigration:
We represent employers who seek to petition for prospective employees either through an H1B (non-immigrant professional visa); H2B (seasonal temporary or peak load non-immigrant visa); National Interest Visa (NIV) for medical doctors and professionals; Labor Certification (PERM) immigrant visa (green card) for skilled and non-skilled workers.
Consular Processing: We work with the National Visa Center (NVC) and consulates all over the world regarding visa processing for loved ones and prospective employees all over the world. We further perfect and file any waivers associated waivers that may be needed including 212 and 601 waivers to waive a prior order of removal , unlawful presence or a crime of inadmissibility. We also practice in I-601a stateside waivers of unlawful presence.
Other Immigration Representation:
Vacating old criminal convictions that have immigration consequences (Padilla Motions); writs of mandamus if your immigration petition has been pending for years with no results, and writs of habeas corpus if you have been in immigration detention for an excessive period of time. We also aid our clients at ICE offices in Burlington, Massachusetts and throughout the United States with issues related to release and custody.
